Children's Online Privacy Protection Act (COPPA) governs information gathering online from or about children under the age of 13. Verifiable consent from a child's parent or guardian is required before collecting, using, or disclosing personal information from a child under the age of 13.
At our website and online features specifically designed for kids, the only use we make of personal information (usually email addresses) is to respond one time to a question or request for information from a child, to allow a child to send product ideas, to allow a child to sign up for an on-line newsletter or to award prizes in a game or sweepstakes feature on our site. We do not otherwise make use of personal information, nor do we provide it to third parties.
We collect no information about you or your child, other than that detailed in the previous section, when you visit our web site unless you choose to provide information to us. When a PakNak ® website needs to collect information about a child under 13 years old, COPPA required information and instructions will be provided by the specific Web page that collects information about the child. The Web page will specify exactly what the information will be used for, who will see it, and how long it will be kept.
There are several exceptions that permit collection of a child's email address without receiving parental consent in advance:
To provide the parents with notice and to seek consent for communications with the child. Note: this may require collection of the parent's email address as well.
To respond to a one time request from a child.
To respond more than once to a child's request; i.e., subscription to a newsletter. However, parental consent is required prior to the second communication.
To protect the safety of a child who is participating on the site; i.e., in a chat room.
To protect the site or to respond to law enforcement; i.e., in the case of a Web site compromise.
Personal information about children under 13 years of age may be needed to respond to his/her communication to us, such as to receive a gift product. Personal information about your child will be destroyed immediately upon completion of its intended purpose. On rare occasions, it may be determined that a communication from a child under 13 years old should be maintained for historical purposes. Should such an occasion occur, PakNak ® will obtain the necessary consent from the child's parent.
Parental Consent
If we decide to collect personal information for other reasons, we will notify parents that it is being requested, disclose the reasons for collecting it, and disclose our intended use for it. We will seek parental consent before collecting any personally identifiable information. If we do collect it, parents may request information on the type of data being collected, view their child’s information, and, if they choose, prohibit us from making further use of their child’s information. We will not provide personal information to third parties.
Kids’ Blog
PakNak ® Kids’ Blog (PakNak.com/kidsblog/) is a safe environment that allows kids to personalize their own screens on PakNak ® servers, select and bookmark favorite PakNak ® sites, send product design ideas, and test new games.
It is our policy to collect only information (such as user name, password, birthday, gender and parent’s or guardian’s email address) that is necessary to participate in Kids’ Blog. We use the provided parent’s or guardian’s email address in order to send an email notifying the recipient that their child has created a Kids’ Blog account and informing them of their child’s user name and password. We do not use the parent’s or guardian’s email address for any other purpose.

Sweepstakes and Contests
If a child participates in a kids’ sweepstakes or contest or submits a winning product idea, we will retain his or her email address for the duration of the contest until a winner is chosen. The winner will be notified by email or another method, as described in the rules. After the contest all participants' email addresses will be deleted from our system. We will not use email addresses in any other way, and we will not provide them to any third party.
U.S. federal law prohibits us from requiring kids to give any more personal information than is necessary to participate in a given activity.
Links to Other Sites
When children click on links from the PakNak ® Kids' Blog to other sites, we may open the other sites in a new browser window.
We make every effort to link to appropriate outside sites for kids. Unlike PakNak ® Kids' Sites, however, these outside sites may collect personal information.
